Consent to Receive Electronic Disclosures

This E-Consent disclosure explains how Fortress Loan and Finance LLC ("Fortress," "we," "us," or "our") provides disclosures, notices, records, and communications to consumers electronically in connection with Payday Cah Advance by Fortress. By using the Services, submitting an application request, or clicking to continue where electronic consent is requested, you agree to receive covered records electronically to the extent allowed by law.
1. Scope of Consent
Your consent applies to legally required notices, service communications, acknowledgments, disclosures concerning privacy and data practices, Terms of Use updates, notices about routing to third-party lenders, support responses, marketing preference confirmations, and other records related to your use of the Services. If these requirements materially change in a way that creates a substantial risk that you may no longer access records, we may provide updated notice where legally required.
4. Paper Copies of Records
You may request paper copies of records covered by this E-Consent by contacting [email protected]. Fortress reserves the right to charge a reasonable administrative fee for paper copies to the extent permitted by law. Requests should include sufficient identifying information to help us locate the relevant records.
5. Withdrawal of Consent
You may withdraw your consent to receive electronic records by contacting us through the contact methods listed below. Withdrawal will apply prospectively and may prevent you from using parts of the Services that require electronic communication. Withdrawal of consent will not invalidate records already delivered electronically before the withdrawal request is processed.
6. Updating Your Contact Information
You are responsible for keeping your email address and other contact information current. Fortress is not responsible for missed notices or delayed communications resulting from outdated, incorrect, blocked, or inaccessible contact information supplied by you.
7. Retention of Copies for Your Records
You should print or save copies of all important electronic records for your own files. Fortress may retain records for legal, compliance, and operational reasons, but we do not guarantee indefinite online availability of any record through the website interface.
8. Consent to Electronic Signatures and Actions
By clicking buttons, checking boxes, submitting forms, or otherwise taking affirmative electronic action, you agree that such actions constitute your electronic signature and indicate your intent to be bound or acknowledged with respect to the relevant record or disclosure, to the extent legally permitted.
9. Consent Does Not Guarantee a Loan Offer
Agreeing to electronic delivery of records does not guarantee that you will receive a loan offer, approval, or funding. Independent third-party lenders remain solely responsible for evaluating eligibility, presenting offers, and issuing contractual disclosures where applicable.
